Terms of Service

These Terms of Service ("Terms") govern your use of the Home Plate mobile application (the "App") operated by Home Plate ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Use of the App

Home Plate provides NCAA college baseball scores, standings, team information, and related content. You may use the App for your personal, non-commercial use in accordance with these Terms.

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws.
• Attempt to reverse engineer, decompile, or disassemble the App.
• Scrape, harvest, or extract data from the App through automated means.
• Interfere with or disrupt the App's servers, networks, or infrastructure.
• Impersonate any person or entity, or misrepresent your affiliation.
• Use the App to distribute spam, malware, or other harmful content.

2. Accounts and Subscriptions

Home Plate Pro

The App offers a premium subscription ("Home Plate Pro") that unlocks additional features including ad-free usage, unlimited favorite teams, push notifications, live radio broadcasts, and grid view. Subscriptions are billed through the Apple App Store.

Billing and Renewal

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel your subscription through your App Store account settings.

Free Trial

We may offer a free trial period for Home Plate Pro. If you do not cancel before the trial ends, your subscription will begin and you will be charged the applicable fee. Free trial eligibility is determined by the App Store.

Refunds

All purchases are processed through the Apple App Store. Refund requests must be made through Apple in accordance with Apple's refund policies.

3. Content and Data

Game Data

The App provides NCAA college baseball scores, statistics, standings, and related data sourced from publicly available sources. We strive to provide accurate and timely information, but we do not guarantee the accuracy, completeness, or timeliness of any data displayed in the App.

No Affiliation

Home Plate is not affiliated with, endorsed by, or officially connected to the National Collegiate Athletic Association (NCAA), any university, conference, or their affiliates. All team names, logos, and related marks are the property of their respective owners and are used for informational purposes only.

User Content

Any feedback, suggestions, or ideas you submit to us may be used by us without obligation or compensation to you.

4. Intellectual Property

The App, including its design, code, features, and original content, is owned by Home Plate and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

5. Advertisements

The free version of the App displays advertisements served by Google AdMob. By using the free version, you consent to the display of such advertisements. Home Plate Pro subscribers have an ad-free experience.

6. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Game data, scores, and statistics may be delayed, inaccurate, or incomplete. Do not rely on the App for wagering or other decisions requiring verified data.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOME PLATE AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use of or inability to use the App.
• Any inaccuracy in game data, scores, or statistics.
• Unauthorized access to or alteration of your data.
• Any third-party conduct or content on or through the App.

8. Indemnification

You agree to indemnify and hold harmless Home Plate and its operators from any claims, damages, losses, liabilities, and expenses arising from your use of the App or your violation of these Terms.

9. Termination

We may suspend or terminate your access to the App at any time, with or without cause. Upon termination, your right to use the App ceases immediately.

10. Changes to These Terms

We may modify these Terms at any time. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the United States and the state in which Home Plate operates, without regard to conflict of law principles.
